1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Backdropper mobile application ("Service") operated by Secret Code ("we," "us," or "our").

By downloading, installing, or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

Backdropper is an iOS mobile application that provides AI-powered background replacement and photo enhancement services. Our Service allows users to:

• Remove backgrounds from photos using AI technology
• Replace backgrounds with custom or provided options
• Enhance product photos for e-commerce
• Generate AI-powered image variations
• Access professional photo editing tools

3. User Accounts and Registration

To access certain features of our Service, you may be required to create an account. When you create an account with us, you must provide information that is accurate, complete, and current at all times.

You are responsible for safeguarding the password and for all activities that occur under your account. You agree not to disclose your password to any third party.

4. Acceptable Use

You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates applicable federal, state, local, or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material, including "junk mail," "chain letter," "spam," or similar solicitation
• To impersonate or attempt to impersonate the Company, an employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service
• To create deepfakes, misleading content, or any content that violates intellectual property rights

5. Content and Intellectual Property

5.1 Your Content

You retain all rights to any content you submit, post, or display on or through the Service ("Your Content"). By making Your Content available through the Service, you grant us a limited, non-exclusive, royalty-free license to use, modify, and process Your Content solely to provide the Service to you.

5.2 Our Content

The Service and its original content, features, and functionality are and will remain the exclusive property of Secret Code and its licensors. The Service is protected by copyright, trademark, and other laws.

6. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

7. Subscriptions and Payment

7.1 Paid Subscriptions

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle").

7.2 Free Trial

We may offer a Subscription with a free trial period. You may be required to enter your billing information in order to sign up for the free trial.

7.3 Billing

All billing is handled by Apple through the App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

8. Cancellation and Termination

You may cancel your subscription at any time through your Apple ID account settings. Your subscription will remain active until the end of the current billing period.

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Disclaimers

The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, this Company:

• Excludes all representations and warranties relating to this Service and its contents
• Does not warrant that the Service will be constantly available, or available at all
• Makes no representations about the accuracy or completeness of AI-generated results

10. Limitation of Liability

In no event shall Secret Code, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

11. Governing Law

These Terms shall be interpreted and governed by the laws of Romania, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

13. App Store Requirements

If you downloaded the app from the Apple App Store, you acknowledge that:

• These Terms are between you and Secret Code, not Apple
• Apple has no responsibility for the Service or content
• Apple is not responsible for addressing claims or third-party intellectual property infringement claims
• Apple is a third-party beneficiary of these Terms and may enforce them
